The Client’s right to use the Service is subject to the following 'Usage
Rules' in relation to any email campaign, whereby the Client agrees and warrants
not to:
1. Use the Services for any unlawful purposes, in contravention with this
Agreement or any laws.
2. Send or encourage the sending of any Material or emails, for any reason,
including, but not limited to chain emails, to:
- recipient/s without their prior permission, or
- recipient/s that have notified the Client that they do not wish to receive
emails from the Client. (collectively 'Spam').
3. Send any offensive Material including, but not limited to: expressions
of bigotry, racism, ageism, hatred, or profanity; sexually explicit material;
or any material deemed by newslettersOnline in
its sole discretion to be offensive.
4. Send any defamatory, inaccurate, abusive, obscene, profane, or threatening
Material. Or send Material that promotes or provides instructional information
about illegal activities, or promoting physical harm or injury.
5. Send Material that contains, computer viruses of any type, including, but
not limited to, trojan horses, worms, encrypted viruses, retroviruses, macro
viruses, or any other type of thing that could threaten or harm any persons information
systems.
6. Send Material that contains, spyware.
7. Send Material, information or software in violation of any local, state
or federal law.
8. Send Material protected by copyright, of any jurisdiction, without the
permission of the copyright owner.
9. Send Material that contains references or hyper links to web pages that
contain nudity, sex, pornography, tasteless images, foul language, hate propaganda,
anything illegal, pirated software, serial numbers for unlocking software, pyramid
schemes or is otherwise insulting, offensive or against the public interest or
contravenes these Usage Rules.
10. In the event that the Client violates any of the above usage rules, or
for any other reason deemed appropriate by newslettersOnline, newslettersOnline reserves
the right to suspend or terminate, with or without notice, access to the Client's
Account and all related data.
